The International Criminal Court (ICC) on Friday terminated the case facing President Uhuru Kenyatta in its entirety.
In a statement issued by ICC spokesman, Fadi El Abdallah, Trial Chamber V (b) Judges said they have decided to terminate the case against Kenyatta after ICC chief Prosecutor, Fatou Bensouda, withdrew the charges against Kenyatta in December last year.
“Noting the Prosecution's withdrawal of charges against Mr Kenyatta, the Chamber decided to terminate the proceedings in this case and to vacate the summons to appear against him, “the judges said.
However, the Judges stressed that, although the proceedings shall be terminated, the Court retains jurisdiction over any interference with a witness or with the collection of evidence and that the protective measures ordered for witnesses and/ or victims shall continue, subject to a review by the Court.
This is a big blow to Bensouda since she was trying to appeal the case so that Uhuru can be arrested and detained at the ICC.
Uhuru was indicted by the ICC in connection with 2007-08 post election violence where 1,300 people died and over half a million were displaced.
