
In Kenya no one is above the law, not even the President, at least that is what the Constitution provides.
However, actions by President Uhuru Kenyatta, his Deputy William Ruto and their Cabinet Secretaries have put the letter and spirit of these constitutional provisions to question.
Yesterday, President Uhuru Kenyatta and Interior Cabinet Secretary, Joseph Nkaisery, were breaking the law right before Kenyans and behaving as if they were above the law.
Whilst the law prohibits the use of public resources to advance political campaigns in support of certain individuals in a political contest, Uhuru used state resources to campaign for JAP’s candidate, Patrick Tutui, to give him a competitive advantage over CORD’s Elijah Memusi in the upcoming Kajiado Central by-election.
The President used a Kenya Airforce helicopter and several GK vehicles to campaign for Tutui yesterday while burning Government fuel.
And as if that was not enough insult to the Constitution, Interior Cabinet Secretary, Joseph Nkaisery, joined him on the campaign trail to drum up support for Tutui in total disregard for the law which prohibits Cabinet Secretaries from directly engaging themselves with politics.
The blatant disregard for the law left many wondering whether Uhuru and his executives were above the law, and if not, whether they should be charged.
